Thirst

Thirst Design Ltd is an established provider of design, web design and development, copywriting and printed materials. All contract for work undertaken is with Thirst Design Ltd.

Price Variation

Prices are based on Thirst’s current costs of production and, unless otherwise agreed, are subject to amendment on, or at any time after acceptance of an order is made. This allows us to meet any rise or fall in costs, such as materials.

VAT

All prices quoted are subject to VAT at the current rate, unless classified as zero rating.

Preliminary Work

Thirst shall charge for all work carried out at a customer’s request, whether experimentally or otherwise. Should a customer suspend work, or should work be delayed through any default of the customer for 30 days, Thirst shall charge for work carried out.

Amends

One set of amends is included in all artwork production. Thirst may charge for any extra work involved after the first set of amends.

Proofs

Thirst will send proofs of all work as Adobe Acrobat pdf files. Thirst shall incur no liability for any errors not corrected on these proofs by the customer. Approval of proofs is required at the earliest possible time by e-mail. Thirst will accept corrections by telephone but the customer must confirm these changes in writing. Thirst will not accept responsibility for any errors arising from corrections notified by telephone. Amendments due to new customer requirements will be charged extra.

Websites

Website hosting is included within all website packages as standard, unless hosting is purchased elsewhere by the client. Hosting packages are renewed on an annual basis automatically to avoid disruption to business activity. Notice of at least 30 days, in writing, is required to cancel hosting. Domain renewal follows the same procedure but on a biannual basis. If domains are not renewed they could be lost forever due to purchase by another.

Approval

All customers are responsible for signing off their stationery. Customers should pay special attention to telephone numbers and e-mail addresses as mistakes are sometimes hard to spot. Customers must signify their approval by e-mail; only at this point will any order proceed.

Printing

Print is only undertaken once Thirst receives full approval from the customer for all aspects of their stationery.

Delivery

No guarantee, either expressed or implied, is given about delivery dates. While every effort is made to meet delivery dates, which are given in good faith, Thirst accepts no liability for late delivery. Delivery is charged for each delivery address. Delivery times are currently five to seven working days from approval of all stationery for standard print and seven to ten working days from approval for deluxe print. Thirst shall not be liable for any loss to the customer arising from delays in transit not caused by them.

Quality

Thirst makes every effort to deliver your printing to a high standard. Printing is always carried out to a cmyk colour process and any customer’s corporate spot colours will be matched as closely as possible using this process. If you are not satisfied with your printed material please tell us immediately on receiving your order. We reserve the right to have you return the original order, at our cost, to inspect any variations of quality and to then agree on any action needed. Although measures are in place for checking incoming digital data, Thirst accepts no liability for information supplied by the customer that is incorrect. This includes typographical errors or reproduction of imagery or logos that are not supplied to the required specification (300dpi at size of reproduction).

Payment

Payment of an Thirst invoice is due within 14 days of receipt (unless otherwise stated on the invoice). Late payment charges will be applied following a 30-day default period from the date of the invoice.

Payment of all template products

Purchase of all template work, and print requests on these materials, is subject to payment at order stage. On payment, proofs will be supplied for viewing and amendment.

Standing Material

Metal, film, disks and other materials owned by Thirst and used by them or suppliers on their behalf in producing plates, setting, negatives, positives, cutters or dies and the like shall remain their exclusive property. Thirst holds all intellectual property rights over images, designs and graphics originated by them for customers unless specifically ordered and paid for by agreement with Thirst. Such items when supplied by the customer shall remain the customer’s property. Under normal circumstances, standing material will be kept on file for two years after which time Thirst reserves the right to dispose of it. Thirst can supply duplicate copies for an extra charge should the customer request them.

Illegal Matter

Thirst shall not be required to print any matter which they think may be of an illegal or libellous nature or an infringement of the proprietary or other rights of any third party. The customer indemnifies Thirst for any claims and expenses arising out of any libellous matter or any infringement of copyright, patent or any other proprietary or personal rights contained in any material printed for the customer. The indemnity shall extend to any amounts paid on a lawyer’s advice in settlement of any claim.

Copyright

The customer shall be responsible for getting all necessary authority to reproduce pictures, artwork, disks, etc. that they supply to Thirst to avoid breach of copyright. Thirst will accept no responsibility for the reproduction of materials supplied to them.

Any materials supplied by Thirst through the template option are subject to strict copyright rules and as such can not be reproduced in any format without Thirst’s approval. Failure to seek approval will result in a breach of copyright and legal proceedings will be processed. Copyright covers all words, design and imagery.

Copyright for all material produced by Thirst will be passed to the client once payment has been made in full.

Data Protection

No information we collect for order processing or from enquiries is shared with any other company or website. Your information is only used by Thirst for marketing purposes or other offers relating to your business.

Law

These conditions and all other express terms of the contract are governed and construed in accordance with the laws of England and Wales.
